Website Terms of Use
The rules for using pointeriaus.com. Reading them takes about five minutes; they matter because this is an insurance website and nothing on it binds coverage.
Effective date: September 17, 2026. Pointer Insurance Agency, LLC, doing business as Wirehaired Trust (“Wirehaired Trust,” “we,” “us”). Licensed independent property & casualty insurance agency in Texas and Florida. Houston, Texas · info@pointeriaus.com · (281) 671-0069.
1. Who we are and how to contact us
pointeriaus.com (the “Site”) is operated by Pointer Insurance Agency, LLC, doing business as Wirehaired Trust, an independent insurance agency licensed by the Texas Department of Insurance and the Florida Department of Financial Services. Contact us at the address above with any question about these Terms.
2. Acceptance
By accessing or using the Site, submitting any form, or contacting us through it, you agree to these Terms of Use, our Privacy Policy, our Cookies Notice, and, if you become a client, our Terms of Business. If you do not agree, do not use the Site.
3. Nothing on this Site binds insurance coverage
Coverage descriptions, premium examples, deductible illustrations, calculators, and any figure you see on the Site are general information. No coverage exists until a licensed insurer issues a written binder or policy. Submitting a form, receiving a quote, or an email or text from us saying we are “working on it” does not bind coverage. Do not cancel existing insurance in reliance on anything on this Site.
Quotes and premium indications are subject to underwriting, inspection, loss history, motor vehicle records, and carrier acceptance, and may change before binding.
4. Not professional advice
Content on the Site is educational. It is not legal, tax, accounting, engineering, or individualized insurance advice, and it does not create an agent–client or fiduciary relationship. Coverage decisions are yours. Consult your own advisors, and read your actual policy: the policy language controls over anything on this Site.
5. Accuracy of what you submit
When you submit information through a form, you represent that it is true, complete, and yours to provide. Insurance applications are underwritten on the information given; a material misstatement or omission can result in a declined application, a rescinded policy, or a denied claim. You are responsible for reviewing every application and policy we prepare on your behalf and telling us promptly if anything is wrong.
6. Permitted use
You may use the Site for your own lawful, non-commercial purpose of learning about and requesting insurance services. You may not:
- scrape, harvest, or bulk-download content or form structures
- submit false, fraudulent, or third-party information without authorization
- probe, scan, or test the Site’s security, or attempt to bypass its Content Security Policy, honeypot, or rate limits
- use the Site to transmit malware or interfere with any user
- frame the Site or use our marks in a way that implies affiliation
7. Consent to electronic communications
By providing an email address or phone number, you consent to receive communications from us electronically, including proposals, policy documents, and notices, and you agree that electronic records and signatures satisfy any requirement that they be in writing (E-SIGN Act; Texas UETA; Florida UETA). You may withdraw this consent by contacting us; withdrawal may require paper delivery and could affect timing. Text-message consent is governed separately by our SMS Terms, and consent to marketing texts is never a condition of purchase.
8. Claims are not reported through this Site
The Site is not a claims-reporting channel. Report claims directly to your insurance carrier using the number on your policy, then notify us. Nothing on the Site, and no message sent through it, constitutes notice of a claim or a coverage determination.
9. Intellectual property
The Site, its text, design, calculators, the Wirehaired Trust name, the covey mark, and the wordmark are owned by Pointer Insurance Agency, LLC or its licensors and protected by U.S. copyright and trademark law. You may print or download pages for personal reference. Any other use requires our written permission.
10. Third-party links
The Site links to carriers, regulators (tdi.texas.gov, myfloridacfo.com), and review platforms. We do not control those sites and are not responsible for their content or privacy practices.
11. Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law we disclaim all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components; you are responsible for your own device security.
12. Limitation of liability
To the fullest extent permitted by law, Pointer Insurance Agency, LLC, its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or coverage, arising out of your use of or inability to use the Site, even if advised of the possibility. Our total liability for any claim relating to the Site is limited to one hundred dollars (US$100). This section does not limit liability for fraud, gross negligence, or any liability that cannot be limited under Texas law, and it does not apply to the professional services we provide as your insurance agent, which are governed by our Terms of Business.
13. Indemnification
You agree to defend, indemnify, and hold harmless Pointer Insurance Agency, LLC and its members, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site, or information you submit that is false or that you were not authorized to provide.
14. Privacy and security
Our Privacy Policy explains what we collect and how we protect it. In summary: the Site loads no third-party scripts, sets no advertising or analytics cookies, accepts form submissions only to its own domain over encrypted connections, and delivers your submission to our agency management system, after which the hosting copy is deleted.
15. Governing law, venue, and dispute resolution
These Terms are governed by the laws of the State of Texas without regard to conflict-of-law rules. Before filing any claim, you agree to notify us in writing and attempt in good faith to resolve it for thirty (30) days. Any claim not resolved will be brought exclusively in the state or federal courts sitting in Harris County, Texas, and you consent to their jurisdiction. Class-action waiver: you agree to bring claims only in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. The prevailing party in any action may recover reasonable attorneys’ fees and costs. Nothing in this section limits your right to file a complaint with the Texas Department of Insurance or the Florida Department of Financial Services.
16. Changes to the Site and these Terms
We may change the Site or these Terms at any time by posting a revised version with a new effective date. Your continued use after a change is acceptance of it. We may suspend or withdraw the Site without notice.
17. General
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the Cookies Notice, the SMS Terms, and, for clients, the Terms of Business are the entire agreement regarding the Site and supersede prior understandings. You may not assign these Terms; we may assign them to a successor. These Terms do not replace any signed agreement, application, binder, or policy, which control over these Terms as to their subject matter.
This page is provided for transparency and is not legal advice. If you have questions about how these Terms apply to you, consult your own attorney.
