1. Purpose of this notice

Title V of the Gramm-Leach-Bliley Act (GLBA) and the insurance privacy rules of Texas (28 TAC Chapter 22) and Florida (Rule 69O-128) require a licensed insurance agency to tell you how it handles non-public personal information. This notice is that disclosure for Pointer Insurance Agency, LLC, doing business as Wirehaired Trust. It applies to information collected through pointeriaus.com, by phone, email, text, and in person, and in the course of placing and servicing insurance. We provide it at the start of a customer relationship and, for customers, annually; the current version is always at this address.

2. What we collect

• Identifiers and contact details you give us: name, business name, mailing address, email, phone.
• Underwriting information you provide on the Smart Intake form or an application: property details, operations, payroll, revenue, vehicles, drivers, claims history, coverage preferences, current carrier, and similar. This is non-public personal information under GLBA.
• Information from third parties as needed to quote and service coverage: motor vehicle records, loss runs, inspection reports, consumer reports where permitted by the Fair Credit Reporting Act, and information from carriers and wholesalers.
• Communication records: emails, texts, and notes of phone calls. We do not record phone calls.
• Technical data collected by our hosting provider in server logs: IP address, browser type, pages requested. See our Cookies Notice; we run no analytics or advertising trackers.

3. What we do not collect on this website

The website collects no payment-card numbers, bank account numbers, Social Security numbers, driver’s license numbers, dates of birth, or health information. If a carrier application requires any of those, we collect it through the carrier’s secure application or by a channel we agree with you, not through a web form.

4. How we use it

• To quote, place, bind, and service insurance, including submitting applications to carriers and wholesalers.
• To respond to your inquiries and communicate about your coverage: proposals, renewals, endorsements, certificates, claims assistance, and service notices.
• To send you information about coverages relevant to you, from which you may opt out at any time.
• To comply with law, respond to regulators, prevent fraud, and defend legal claims.
• To operate and secure the website (server logs only).

5. Who we share it with

We share non-public personal information only as permitted by GLBA and state law:

• Insurance carriers, wholesale brokers, managing general agents, and surplus-lines markets to which we submit your application.
• Service providers that act on our behalf under confidentiality obligations: our agency management system (Momentum / NowCerts), our website host and form processor (Netlify), our email provider (Google Workspace), inspection and loss-control vendors, and premium finance companies when you elect financing.
• Regulators, courts, and law enforcement when required by law, subpoena, or examination.
• A successor in the event the agency is sold or merged, under the same obligations.

We do not sell, rent, or trade your personal information, and we do not share it with unaffiliated third parties for their own marketing. We do not share your information with any other business Nick Buchanan or the agency’s owners are involved in.

6. How the website handles your submission

When you submit a form, your browser sends it over an encrypted (TLS) connection only to pointeriaus.com. Our hosting provider receives it, triggers delivery to our agency management system, and sends a notification to our agency mailbox. The hosting provider’s copy of the submission is deleted automatically as soon as delivery to our agency management system is confirmed. Our server logs mask email addresses, phone numbers, addresses, and every underwriting answer. The form clears every field and all browser storage the moment it is sent, so nothing remains on a shared or public computer.

7. Security

We use administrative, technical, and physical safeguards appropriate to an insurance agency: HTTPS with HTTP Strict Transport Security; a strict Content Security Policy that permits no third-party scripts and no inline code; forms that can only post to our own domain; anti-spam honeypots; multi-factor authentication on the systems that hold client records; access limited to personnel who need it; and a written information-security program. No transmission or storage method is perfectly secure, and we cannot guarantee absolute security. If you believe your information has been compromised, contact us immediately.

8. How long we keep it

• Inquiries that do not result in a policy (including Smart Intake submissions and contact-form messages) are deleted within twenty-four (24) months of the last contact.
• Client records for policies we place are retained as Texas and Florida insurance-records rules require, generally for the policy term plus at least five (5) years after expiration, then securely destroyed.
• SMS consent records are retained for as long as required to demonstrate consent under the Telephone Consumer Protection Act and for four (4) years after opt-out.
• Server logs are retained by the hosting provider for a short period under its own policy and are not used by us to identify individuals.

9. Your rights and choices

You may, at any time:

• Access the personal information we hold about you and receive a copy.
• Correct inaccurate information.
• Delete information we are not required by law or contract to retain.
• Opt out of marketing email or text messages (reply STOP to any text, or use the unsubscribe link or contact us). Opting out does not affect service communications about coverage you hold.
• Withdraw consent to electronic delivery or to being contacted at a phone number.

Send requests to info@pointeriaus.com or (281) 671-0069. We will verify your identity and respond within thirty (30) days. You may designate an authorized agent by providing written authorization. We will not discriminate against you for exercising these rights. Some information must be retained by law (for example, records of policies placed) and cannot be deleted on request; we will tell you if that applies.

10. Texas and Florida residents

Texas residents have the rights above under the Texas Insurance Code and 28 TAC Chapter 22, and may have additional rights under the Texas Data Privacy and Security Act. Florida residents have the rights above under Florida Statutes Chapter 626 and Rule 69O-128, and the right to be notified of a data breach under the Florida Information Protection Act. Insurance agencies are financial institutions under GLBA, and information collected for insurance purposes is generally exempt from state consumer-privacy statutes; where those statutes apply to any information we hold, we honor them.

11. Text messages

Our text-message programs, consent, frequency, and opt-out instructions are described on our SMS Preferences page. Mobile numbers and SMS consent are never shared with third parties for their marketing.

12. Children

The website and our services are for adults. We do not knowingly collect information from anyone under 18. If you believe we have, contact us and we will delete it.

13. Third-party websites

Links to carriers, regulators, Google Maps, and social networks lead to sites we do not control. Their privacy practices govern once you leave ours.

14. Changes

We may update this notice. Material changes will be posted here with a new effective date, and customers will receive notice as GLBA requires. Continued use of our services after a change is acceptance of it.
